Key Information Before You Order

While the full Terms & Conditions are set out below, here are some important points to know before becoming a customer:

  • All Products listed on our website are subject to availability. If a product in your order is unavailable, we may substitute it with a similar product of equal or higher value at no extra cost.

  • We may cancel an order at any time before delivery for any reason, even if previously accepted.

  • Our liability under these Terms is limited to the price you paid for the affected products, and we are not responsible for indirect or consequential loss.

  • We are not liable for loss, damage, delay, injury, or failure caused by events outside our reasonable control or by your own acts or omissions.

  • We may amend these Terms at any time by publishing updated terms on our website.

  • Nothing in these Terms affects your statutory rights under UK consumer law.

 

  1. 1. Introduction

    This website (“Site”) is operated by Heaps Normal Ltd (“we”, “our”, or “us”). These Terms & Conditions (“Terms”) form a contract between you (“you” or “the customer”) and us for the purchase of our clothing and related accessories (“Merchandise”) and/or non-alcoholic beverages (“Beverages”), collectively “Products”, through the Site.

    2. Use of the Site

    By placing an order, you accept these Terms.

    You must be at least 16 years old to use our Site and place an order.

    When using our Site, you must not:

    • breach any laws or infringe on anyone’s rights (including privacy rights);

    • defame, harass, threaten, or otherwise harm others;

    • use the Site for unlawful purposes;

    • interfere with others’ use of the Site;

    • introduce viruses, malware, or other harmful technology;

    • send spam or unsolicited communications;

    • use automated tools (e.g., bots, scrapers) to extract data; or

    • help others to do any of the above.

    3. Accounts

    You can shop without an account or create one to save order history and wish lists.
    You must keep your account details safe and ensure all information is accurate and up to date. You are responsible for all activity under your account.

    Your personal information will be handled in accordance with our Privacy Policy and UK GDPR.

    4. Orders

    When you place an order, you are offering to buy the Products for the listed price (including applicable delivery fees, charges, and taxes).

    We may accept or reject orders at our discretion. A binding agreement forms when we send you an order confirmation email.

    You are responsible for checking all order details before submitting your order.

    We do our best to keep stock information up to date, but all purchases are subject to availability. We may cancel orders before delivery if:

    • there is a significant delay in dispatch,

    • we cannot supply the Products (e.g., due to events beyond our control), or

    • there was an error on the Site (e.g., price or description).

    If we cancel, you can choose a refund, store credit, or backorder. Delivery fees will also be refunded if you choose a refund or store credit.

    5. Price & Payment

    Prices are stated in pounds sterling (£) and include UK VAT where applicable.

    You must pay in full at checkout using one of the payment methods listed on our Site.
    We accept payment via third-party providers (e.g., Stripe, PayPal). We do not store card details; payment processing is handled securely by our payment partners.

    Promotional codes must be entered at checkout and are subject to any additional terms stated on the Site.
    Competitions may be run from time to time, subject to separate terms.

    6. Delivery, Title & Risk

    We deliver across the UK (excluding areas where our delivery partners do not operate). Delivery fees are shown at checkout.

    Dispatch times are estimates only and may vary due to courier delays or other factors.

    Title (ownership) passes to you when we receive full payment. Risk passes to you upon delivery.

    If you need to change your delivery address or date, contact us as soon as possible.

    7. Returns & Refunds

    7.1 Change of Mind – Merchandise

    We offer exchanges (subject to stock availability) if:

    • You provide proof of purchase within 30 days of delivery;

    • Items are unused, unworn, unwashed, undamaged, and in their original packaging with tags attached;

    • Items are not sale items, personalised/custom goods, special buys, or gift vouchers.

    Return postage for change-of-mind returns is at your cost.

    7.2 Change of Mind – Beverages

    We offer a “first sip guarantee” for Beverages purchased directly from our Site. If you are unhappy with the taste, email us at online@heapsnormal.com with your feedback, and we’ll refund you. You can keep the remaining product.

    7.3 UK Consumer Rights

    Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
    You are entitled to a refund, repair, or replacement if the goods are faulty, not as described, or unfit for purpose. For faulty items, we will refund return delivery costs.

    8. Limitations of Liability

    Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under UK law.

    To the maximum extent permitted by law:

    • Our total liability for any claim is limited to the amount you paid for the relevant Products; and

    • We are not liable for loss of profits, revenue, goodwill, data, or any indirect or consequential losses.

    We are not responsible for losses caused by events outside our reasonable control (e.g., extreme weather, strikes, pandemics, transport issues).

    9. Intellectual Property

    All intellectual property rights in our Site and Products remain ours. You may use our content for personal, non-commercial purposes only.

    You may share our content on social media if you:

    • Credit us as the owner;

    • Do not claim endorsement without our written consent;

    • Do not damage our reputation; and

    • Comply with these Terms.

    10. User Content

    If you post content about us (e.g., on social media using our hashtags), you grant us a royalty-free, worldwide licence to use it for marketing and promotional purposes.

    You must have the rights to any content you share and ensure it does not infringe others’ rights.

    11. General Terms

    • Disputes: Both parties will try to resolve disputes informally before going to court.

    • Notices: We may contact you by email or post.

    • Assignment: You may not transfer your rights under these Terms without our written consent.

    • Entire Agreement: These Terms form the entire agreement between us regarding your purchase.

    • Amendments: We may update these Terms at any time by publishing them on our Site.

    • Governing Law: These Terms are governed by the laws of England & Wales, and disputes will be subject to the exclusive jurisdiction of its courts.

    • Third-Party Sites: We are not responsible for content or services provided by linked third-party websites.
